Money Problems - Facing Repossession


We are regularly contacted by people who through no fault of their own have fallen behind with their mortgage and other debts. 

What stage of the repossession process are you at?
  1. 2 to 4 months – Having missed a number of mortgage or loan payments you can expect to be contacted by your mortgage company's collection department.  At this stage you must try to explain to your lender(s) what has gone wrong and if possible arrange to clear the arrears. 

  2. 4 to 6 months – If you get this far into arrears, in all likelihood your account will have been passed to the lender's solicitors for them to start legal proceedings against you. 

  3. 6 months Plus – You can expect a Court Summons any day. Whatever you do, do not ignore this. Doing so will harm your case. Make sure you attend the hearing in person so that you can explain your circumstances to the judge. You can be sure that your lender will have their solicitor in court to explain their side of things.
At the hearing the Judge will decide to do one of the following:-  

  • Adjourn (postpone) 

  • Strike (cancel) 

  • Form an agreement allowing you to stay on in your home providing you repay the arrears in installments. 

  • Give you an amount of time to sell the property and avoid repossession.

  • Issue an eviction notice. 
Should the judge decide that repossession is the only realistic solution, a court order will be issued and a date set by which you have to leave your home. If you do not leave by this date, a bailiff's warrant can be obtained and you will be removed from your home.
